Privacy
Talking to the agent
When you speak to the agent, your audio streams live to Cartesia, which transcribes your speech and generates the reply voice. The transcript streams to Cerebras, which runs the language model that writes each reply. Both are providers in the United States. When you type instead of speak, only text is sent, and no audio leaves your device.
We do not store your voice. The audio stream is processed in real time and discarded after the turn it belongs to. Cartesia may retain processed content, including audio, under its own service terms and data processing agreement.
To run, debug, and improve the service we keep the text transcript of the conversation together with turn timings and error codes, on our own server in the United States. These records hold no audio and are deleted after 90 days.
Do not read out or type passwords, payment details, or other sensitive data. The agent is a general assistant, not a secure channel.
What you send us directly
If you submit an inquiry or contact form, we collect the name, email, company, and message you enter. It reaches us over Slack and email. We use it to answer you and to follow up on the request. We do not sell it.
Site analytics
We use PostHog in cookieless mode to understand how the site is used: pages visited, referring URL, and device and browser type. It stores nothing on your device, sets no cookies, and identifies a visitor by a hash that rotates daily, so visits on different days cannot be linked. You can object to this processing at any time by emailing hey@softcery.com.

Your data is processed in the United States, and the agent and its telemetry run on United States infrastructure. Transfers out of the European Economic Area rely on each provider's own safeguards under the terms we accepted with them: certification under the EU-US Data Privacy Framework where the provider holds it, or the standard contractual clauses in the provider's data processing terms. Conversation records on our own server are protected by the measures described above: access limited to Softcery, no audio, deletion after 90 days.
Legal bases
We process contact data to answer your request and act on it (contract and legitimate interest). We process agent audio and text to give you the reply you asked for and to keep the service working (legitimate interest in running the service you invoked). We run analytics on our legitimate interest in understanding site usage; you may object at any time.
Retention
Conversation transcripts and operational telemetry are deleted after 90 days. Inquiry data is kept as long as needed to handle the request and any follow-up, then deleted. Audio is not retained by us at all.
Your rights
Under the GDPR you may access, correct, delete, restrict, or object to the use of your personal data, and request a copy in portable form. To act on any of these, email hey@softcery.com. You may also complain to the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon).
Children
The site and the agent are aimed at businesses and are not directed at children under 13. We do not knowingly collect their data.
Automated decisions
The agent generates replies automatically, but we make no automated decisions about you that carry legal or similarly significant effect.

By using the site or the agent, you accept these terms.
The agent
The agent is an automated system. Its replies are general information, not professional, legal, or financial advice. It can be wrong or incomplete; check anything you plan to rely on. Nothing it says forms an offer or a contract, and it cannot enter agreements on Softcery's behalf. Any work we do for you is governed by a separate written agreement.
Acceptable use
Use the site for lawful purposes only. Do not interfere with its operation, scrape it at a rate that degrades service, probe or overload the agent, or attempt access you are not granted. Do not send the agent passwords, payment details, or other people's personal data.
Intellectual property
The site, its text, graphics, and software are owned by Softcery or its licensors. Do not reproduce, distribute, or build derivative works from them without our written permission.
No warranty and liability
The site and the agent are provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, Softcery is not liable for indirect, incidental, special, or consequential damages arising from their use. Nothing in these terms limits liability that cannot be limited under applicable law.
Governing law
These terms are governed by the law of Estonia, without regard to conflict-of-law rules.
Changes
We may update this page. The date above marks the latest revision. Continued use after a change takes effect is acceptance of the revised terms.
